General terms and conditions of sale

Article 1 — Purpose and scope

These general terms and conditions of sale govern the contractual relationship between WANDERS SAS (operating under the LB Yachting brand), registered with the Antibes Trade and Companies Register under number 830 270 104, and its customers, in connection with the sale of new boats, pre-owned boats and associated services.

Any order implies unreserved acceptance of these general terms and conditions of sale.

Article 2 — Orders

Every order is the subject of a purchase order or sales contract signed by the customer, specifying the boat’s characteristics, the price, the options selected and the estimated delivery times.

Article 3 — Prices

Prices are stated in euros. Unless otherwise stated, they are exclusive of tax for new boats. Any taxes, registration fees, launching and delivery costs are specified in the sales contract.

Article 4 — Deposit and payment terms

The order of a new boat requires the payment of a deposit upon signing, the amount of which is specified in the contract. The balance is payable according to the schedule defined in the sales contract, at the latest upon delivery.

Article 5 — Delivery

Delivery times are given for information purposes only. A delay in delivery may not give rise to cancellation of the order or the payment of damages, unless otherwise stipulated in writing.

Article 6 — Transfer of ownership and risk

Transfer of ownership takes place upon full payment of the price. Transfer of risk takes place upon delivery of the boat to the customer.

Article 7 — Warranties

New boats benefit from the manufacturer’s warranty, under the conditions and durations specific to each shipyard. Pre-owned boats are sold in the condition described in the contract. The customer benefits from the legal warranties of conformity and against hidden defects under the conditions provided by law.

Article 8 — Right of withdrawal

The sale of boats between professionals and individuals on our premises is not subject to the right of withdrawal applicable to distance selling. Any specific withdrawal conditions are specified in the contract.

Article 9 — Retention of title

WANDERS SAS retains ownership of the boat until full payment of the price, in principal and incidental costs.

Article 10 — Personal data

Data collected in connection with the sale is processed in accordance with our privacy policy. The customer has the right to access, rectify and delete their data by writing to info@lb-yachting.com.

Article 11 — Disputes and applicable law

These terms and conditions are governed by French law. In the event of a dispute, and failing amicable resolution, jurisdiction is granted to the courts within the jurisdiction of WANDERS SAS’s registered office, subject to mandatory legal provisions.
